Firm Prevails in Supreme Court Merits Case Against Facebook

On Friday, the Supreme Court dismissed Facebook’s appeal of the firm’s Ninth Circuit victory in a securities fraud case. Kevin argued the case of Facebook v. Amalgamated Bank, No. 23-980, on behalf of investors earlier this month. At the argument, Kevin argued, among other things, that the case did not present the question the Court had granted certiorari to decide and that Facebook had not preserved the alternative argument on which it had focused after persuading the Court to grant its petition. Shortly after argument, the Court issued a rare order dismissing the case as “improvidently granted.” The decision reinstated the investors’ victory in the court of appeals.
